These Terms of Service ("Terms") govern your use of MarketingIQ, operated by NerdJoy ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.
MarketingIQ is a marketing intelligence platform that connects to your third-party marketing tools and uses AI to help you analyze and understand your marketing data. The Service is provided as-is and is currently in early access.
You must be at least 18 years old and capable of forming a binding contract to use the Service. If you're using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
You're responsible for keeping your account credentials secure. You're responsible for all activity under your account. Notify us immediately at heather@nerdjoy.tech if you suspect unauthorized access.
Paid plans are billed monthly via Stripe. Your subscription renews automatically unless you cancel before the renewal date. We offer a 14-day free trial on all paid plans — a payment method is required to start the trial and you'll be charged at the end of the trial period if you don't cancel.
Refunds. We don't offer refunds for partial months. If you cancel, you'll retain access through the end of your current billing period.
Promo codes. Promotional codes (including EARLYBIRD50) are applied at checkout and subject to the terms stated at time of redemption. Codes are non-transferable and cannot be combined.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
When you connect a third-party platform (Klaviyo, Shopify, GA4, etc.), you authorize MarketingIQ to access that platform's API on your behalf. You represent that you have the right to grant this access.
You own your data. We don't claim ownership of any data you bring into the Service. See our Privacy Policy for details on how we handle it.
You're responsible for ensuring your use of the Service complies with the terms of service of any connected third-party platforms.

The Service uses AI (Claude by Anthropic) to generate analysis, recommendations, and insights. AI outputs are not professional financial, legal, or marketing advice. You should apply your own judgment before acting on any AI-generated recommendation. We are not liable for decisions you make based on the Service's outputs.
AI responses are grounded in your live connector data but may contain errors or omissions. Always verify important findings in your source platforms.
The Service, including all software, design, and content created by NerdJoy, is owned by NerdJoy and protected by applicable intellectual property laws. These Terms don't grant you any ownership rights in the Service.
You retain ownership of all data and content you bring into the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR COMPLETE.
TO THE FULLEST EXTENT PERMITTED BY LAW, NERDJOY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold NerdJoy harmless from any claims, losses, or damages (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
Upon termination, your right to use the Service ends immediately. We may retain certain data as required by law or our data retention policies.
We may update these Terms as the Service evolves. We'll note the updated date at the top and, for material changes, notify you by email at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Texas.
